While the Yerevan Municipality continues to issue new construction permits in the very heart of the city, Tumanyan 2nd Passage, blatantly violating property rights and disregarding the positions expressed in the Constitutional Court’s Decision No. SDO-1789 of 1 July 2025, as well as without waiting for the outcome of initiated criminal proceedings, the courts have once again confirmed the violation of the rights of Andranik Sarkavag Manukyan.
By its decision of 25 August 2025, the Criminal Court of Appeal of Armenia upheld the special appeal filed by legal representative Arnold Vardanyan against the prosecutor’s decision not to initiate criminal prosecution against the head of the construction company. The Court annulled the prosecutor’s decision, recording a violation of Mr. Manukyan’s constitutional right to a fair trial, given the lack of an effective investigation.
The Court further reaffirmed our long-standing argument that the expert opinion in this case confirmed the unlawfulness of the construction project: the positive conclusion approving the building design did not comply with the urban planning regulations in force at the time, and the required spacing between buildings under the master plan was not respected.
